Terms of Service

1. Acceptance of Terms

By accessing and using VMFrost's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

These terms constitute a legally binding agreement between you and VMFrost. We reserve the right to modify these terms at any time, and continued use of our services after changes constitutes acceptance.

2. Account Registration

When you register for VMFrost, you will receive a unique authentication token. This token is your sole means of accessing your account. You are responsible for:

• Keeping your authentication token secure and confidential
• All activities that occur under your token
• Notifying us immediately of any unauthorized use

Important: We cannot recover lost tokens. There is no password reset or account recovery process by design to maintain your anonymity.

3. Acceptable Use Policy

While we respect privacy and anonymity, you must use our services lawfully. The following activities are strictly prohibited:

• Hosting, distributing, or linking to child sexual abuse material (CSAM)
• Conducting or facilitating distributed denial-of-service (DDoS) attacks
• Hosting malware, ransomware, or other malicious software
• Phishing, fraud, or identity theft operations
• Unauthorized access to computer systems (hacking)
• Spamming or sending unsolicited bulk emails
• Any activity that violates German law or EU regulations

Violation of this policy will result in immediate service termination without refund and may be reported to law enforcement.

4. Payment and Billing

All payments are processed in cryptocurrency. By making a payment, you agree to the following:

• Payments are non-refundable after the initial 24-hour guarantee period
• You are responsible for any blockchain transaction fees
• Services are billed monthly in advance
• Failure to pay will result in service suspension and eventual termination
• No credits or refunds for partial months

Prices are subject to change with 30 days notice. Existing customers will be grandfathered at their current rate for the duration of continuous service.

5. Service Level Agreement (SLA)

We strive to maintain 99.9% uptime for all services. However, we do not guarantee uninterrupted service and are not liable for:

• Scheduled maintenance (announced 48 hours in advance)
• Force majeure events (natural disasters, war, etc.)
• Issues caused by your configuration or software
• DDoS attacks or other malicious third-party actions
• Internet connectivity issues outside our infrastructure

6. Data and Backups

While we perform regular system backups, you are solely responsible for backing up your data. We are not liable for any data loss, regardless of cause.

Backups are provided as a courtesy and are not guaranteed. We recommend maintaining your own independent backup solution for critical data.

7. Resource Usage

Your server is allocated specific resources (CPU, RAM, storage, bandwidth) based on your plan. You may not:

• Use excessive resources that impact other customers
• Attempt to circumvent resource limitations
• Run cryptocurrency mining operations (except on dedicated mining plans)
• Host file sharing or torrent trackers generating excessive bandwidth

We reserve the right to throttle or suspend services for excessive resource usage.

8. Intellectual Property

You retain all rights to your content and data. We do not claim ownership of anything you store on our servers. However, you grant us the necessary technical rights to provide the service (e.g., storing, transmitting, and backing up your data).

9. Termination

Either party may terminate service at any time:

• You: Cancel anytime from your dashboard. No refunds for partial months.
• Us: We may terminate immediately for policy violations without refund.

Upon termination, all data will be permanently deleted within 7 days. Download any data you wish to keep before canceling.

10. Limitation of Liability

VMFrost provides services "as is" without warranties of any kind. To the maximum extent permitted by law:

• We are not liable for any direct, indirect, or consequential damages
• Our total liability is limited to the amount you paid in the last 30 days
• We are not responsible for your content, data loss, or business interruption
• You use our services at your own risk

11. Governing Law

These terms are governed by the laws of Germany. Any disputes will be resolved in German courts. By using our services, you consent to the jurisdiction of German courts.
